With the demand of highly skilled laborers in the US, gaining green card citizenship for these employees becomes easy.
- Their employer usually does the applicant applying through labor certificate; the companies who have recruited them will sponsor their green card citizenship. In order to bring highly skilled employees from outside to US, the company must meet the below requirements
- on approval of labor certification from Department of Labor (DOL), apply for form I-140 with USCIS
- Employers who sponsor for their alien employee must show that the employee is capable of paying the wages as per the labor certificate.
- The petition must prove that the hired foreign employee is capable of meeting the job requirements- job qualification, education and experience

1. In case of approved I-40 certificate- they can apply for Permanent residence
- Can file for I-485 application –Adjust Status to Permanent Residence
- Must be present lawfully – inspected by immigration officer at the port-of-entry to check their immigration status
- Must get their Immigration Medical Exam
- Not be under any criminal record and absolute security clearance must be maintained.
2. Applicants who possess Master’s degree or Bachelor’s degree along with their experience
- Apply through H-1B visa – Entry to US through specialty occupation
- H-1B visas given for maximum of three years- renewable for six years
3. Applicants who possess Specialized Knowledge – Professionals
- Individuals with skilled professions like architecture, engineers, lawyers, physicians, surgeons and elementary, college, university professors, teachers can apply.

4. Skilled Workers:
- Applicants who take on seasonal or temporary jobs, with a two years of experience
- Requirement of the undergraduate degree, vocational training apprenticeship
5. Unskilled Workers
- Education less than two years of higher studies, training or experience
- Labor oriented jobs where skilled or qualified workers are not available in the US
- The applicant can have any education, training, or experience as per the labor certification.
