  • 30April_1It has been seen that since October, the fewest number of illegal immigrants in the country of the United States of America have been sent home, ever since the time President Obama assumed office in the year 2009.

    A number of steps have been taken by President Obama ever since he assumed Presidency in the year 2009, as per government data sought internally. A number of immigrants have been allowed to stay on, for up to two years at a time, and this is even though they are illegal.

    A record number of more than 409,000 people were sent home by the Immigration and Customs Enforcement authorities in the year 2012, but ever since, the number has slowly dropped into a trickle. The agency is renowned for digging out illegal immigrants and then removing them from the country. Around 11 million immigrants are estimated to be staying on in the country illegally. A number of factors have been attributed to the drop in the crossing. One of them is the drop in the number of arrests of immigrants who were trying to cross the border.

  • 30April An immigration applicant may be eligible for naturalization in the United States if the applicant meets the following conditions:

    • Should have stayed on the basis of permanent residence or as a green card holder for a minimum period of 3 years
    • Should have a U S citizen spouse during the entire time
    • Should also meet all other eligibility requirements as applicable.

    Section 319(a) of the Immigration Act is applicable for the process of naturalization.

    In some cases, those spouses of U S citizens who have been employed abroad may also qualify for naturalization without any regard to the time spent by them as permanent residents. These spouses can also then qualify under Section 319(b) of the Immigration and Nationality Act.

    GENERAL ELIGIBILITY RULES:

    There are certain criteria to be met by an applicant for naturalization:

    • Should be of 18 years or older.
    • Should be staying as a permanent resident for at least 3 years before the date of filing for Form N-400, the Application form.
    • Should have been married to and living with a spouse who is a U S citizen.
    • Should have stayed for a constant period in the United States from the date of applying for naturalization until the time naturalization is done.
    • Should have lived within the state with USCIS jurisdiction for at least 3 months before the date of filing the application of naturalization.
    • Good cognizance the English language is a pre-requisite, coupled with an understanding of U S history and civics.

    HEALTH ISSUES THAT COULD BE A SPANNER IN THE WORKS

    If you do not have any health issues and no chronic diseases or medical conditions then you need not worry. But problems could arise if you have a medical condition or any chronic diseases.

    WHAT DO YOU DO IF YOU HAVE A CHRONIC CONDITION?

    The best thing to do would be to avail of medical records of your condition and carry them with you to the Green Card Medical Examination. Also, it would be advisable to obtain a letter signed by your personal doctor, who will attest the condition of your medical problem and how you are being treated.

    In case you have a history of drug usage, it would be best to get a certificate from either your doctor or your counselor who will testify on record the time period for which you have stayed drug-free. As an added precaution, go in for the drug test in advance and carry the results of the exam to the Green Card Medical Examination.

  • PROBLEMS FACED BY CHILDREN OF ILLEGAL IMMIGRANTS IN THE UNITED STATES
  • 28April_1 Over the years more than 10 million illegal immigrants have settled down in the United States, with many forming new families and having children. It has now been seen that one out of every 15 children who live in the United States of America has an illegal parent, and most of these children have turned US citizens.

    It would be useful to ponder on what these children must be going through on a daily basis- they must be living with the knowledge that the US government could take their parents away. This would be a terrible price to pay for the children of these illegal immigrants. Anxiety and fear amongst the children are the two terrible factors that doctors and counselors have to surmount. Studies have shown that the constant fear leaves behind in its wake, growth problems amongst the children – these children have been shown to display lower academic performance and high levels of anxiety.

    According to a recent estimate around 5 million children in the United States are suffering, due to having at least 1 immigrant parent, and what’s more, more than 5 million of these children have been born in the country.

    So what then could be the solution? Legalization could be one of the ways out. Legalization could place these children on a level playing ground with other children of their age in the country. President Barack Obama’s executive actions had offered a short term fix to the problem. The very same actions are however been put on the back burner due to a court ruling.
