  • 26-MarchApril 17 will see a court hearing that will explore whether a temporary hold on the immigration executive action by President Barack Obama should be lifted or not, it was announced by a Federal Appeals court on Tuesday.

    The executive actions by President Obama could spare from deportation as many as 5 million people, who are in the United States illegally. This action was put on hold by a preliminary injunction that was issued last month by a U S District Judge in Texas, an injunction which was issued at the request of a collective 26 states that filed a lawsuit that strived to overturn the President’s immigration plan. These states argued that the President’s action was unconstitutional. The Justice Department earlier in the month filed an emergency motion with the 5th Circuit, asking the Judge to lift Hanen’s preliminary injunction. It argued that the order interfered with the Homeland Security Department’s ability to protect the country and secure its borders. The 26 states, which were led by Texas stated that they would suffer irreversible economic harm if the injunction was lifted. The 5th U S Circuit Court in New Orleans stated that each side would have an hour to present their arguments about the injunction during the April hearing.

Even though these numbers have dropped since, they are still significant enough to cause alarm. More than 7000 children were caught from the countries of El Salvador, Honduras and Guatemala in the year 2015. Under U S law provisions children from Mexico are usually sent back.

    It has been seen that many of these kids are subsequently released to the custody of a parent or guardian already in the U.S. From these, the state of New York receives the 2nd largest number of such unaccompanied children that are released to the sponsors – only the state of Texas has more unaccompanied children.

    But for these children the journey is anything from over. Although they may be with a family member they may still have a court date to meet. A target date of 21 days from initial processing for each child to appear in court has been set by the Obama administration, and most children may or may not have a lawyer. Under the law all immigrant unaccompanied children are entitled to a lawyer, yet the U S administration is not obliged to provide them with such legal representation.
